SPDES APPLICATION SUBMITTED

KINGSTON, NEW YORK - Besicorp-Empire Development Company, LLC has submitted its draft State Pollutant Discharge Elimination System Application (SPDES) to the New York State Department of Environmental Conservation in connection with a facility the firm plans to construct in the City of Rensselaer.

The SPDES permit is part of the required New York State permitting process in Besicorp-Empire's proposed construction of a state-of-the-art natural gas-powered cogeneration facility. The facility will produce approximately 500 megawatts of electricity for the New York State merchant market and will integrate a recycled newsprint manufacturing facility that will produce over 330,000 metric tons of 100% recycled newsprint per year.

The permitting/approvals phase of the project is scheduled for completion in the fourth quarter of 2002, with construction targeted for the first quarter 2003 and commencement of operations in mid to late 2004.

The facility is being sited at a former chemical manufacturing plant location along the Hudson River in upstate New York, city of Rensselaer, and will result in the re-deployment of an inactive industrial site.
