BESICORP-EMPIRE ARTICLE X AND DEIS STIPULATIONS APPROVED
FOR IMMEDIATE RELEASE KINGSTON, NEW YORK - Besicorp-Empire Development Company, LLC (the "Company") and key government agencies have signed the Stipulations outlining the scope for the combined Article X Application and Draft Environmental Impact Statement ("DEIS"). The Article X Application and DEIS is to be filed with the New York State Department of Public Service ("NYSDPS") and the New York State Department of Environmental Conservation ("NYSDEC") in connection with the cogeneration power facility and recycled newsprint manufacturing facility the Company plans to construct in the City of Rensselaer, New York. Sign off of the Stipulations was obtained from the NYSDPS, the NYSDEC, the New York State Department of Health, and the City of Rensselaer. Agreement on the Stipulations is a prerequisite to filing the Article X Application and DEIS, scheduled for December 2001. The Stipulations detail the studies, evaluations, and analyses that the Company will perform for the Article X Application and DEIS. A first draft of the Stipulations was presented in the Article X Preliminary Scoping Statement and SEQR Draft Scoping Document filed last November. The Stipulations were revised after a series of public meetings were conducted to identify questions raised by the public. The proposed power facility will produce approximately 500 megawatts of electricity for the merchant power market and will also supply all of the energy for the proposed recycled newsprint manufacturing facility, designed to produce over 300,000 metric tons of 100% recycled newsprint per year. "Reaching agreement on the Stipulations is yet another important milestone in the permitting phase of this exciting venture," said Dick Clark, Vice President of the Company. "We continue to move towards the successful completion of this environmentally-sound and economically beneficial project."
